Easement - Gain or Loss, IRS needs to know |
EASEMENTS; The amount received for granting an easement is subtracted from the basis of the property. If only a specific part of the entire tract of property is affected by the easement, only the basis of that part is reduced by the amount received. If it is impossible or impractical to separate the basis of the part of the property on which the easement is granted, the basis of the whole property is reduced by the amount received.
Any amount received that is more than the basis to be reduced is a taxable gain. The transaction is reported as a sale of property.
If you transfer a perpetual easement for consideration and do not keep any beneficial interest in the part of the property affected by the easement, the transaction will be treated as a sale of property. However, if you make a qualified conservation contribution of a restriction or easement granted in perpetuity, it is treated as a charitable contribution and not a sale or exchange, even though you keep a beneficial interest in the property affected by the easement.
If you grant an easement on your property (for example, a right-of-way over it) under condemnation or threat of condemnation, you are considered to have made a forced sale, even though you keep the legal title. Although you figure gain or loss on the easement in the same way as a sale of property, the gain or loss is treated as a gain or loss from a condemnation

Foreclosure |
Buying at the foreclosure sale may be RISKY:
1. Cash is required, either at the sale or shortly thereafter (for safety, bring cashier's checks payable to yourself that you can endorse over to the foreclosing officer as he directs); 2. No title insurance on your title until six months or more after the sale (so the title insurer can check for any irregularities in the conduct of the sale); 3. Will not be able to inspect the house before the auction; 4. The foreclosing lender makes no warranties or representations (you might think you are bidding on a foreclosed first loan but there is a prior recorded loan so you're really bidding on a foreclosed second loan); and 5. If you buy "subject to" a senior loan, which will become your obligation to take over payments, that lender could refuse to let you take over payments (although most lenders are only too happy to have a stronger buyer taking title).

Public Hearing - Appeal against subdivision |
|
On 14 March 2004, an appeal before the Orange County Board of Supervisors will be heard protesting against the further subdivision of an established lot belonging to Tract 1129 situated on the busy intersection of Gilbert Street and Orange Avenue. This goes against the CC&R for this particular tract established in 1947 which consist of uniform lots of 3/4 acre size with one single family homes. There are 12 custom ranch style homes built which still retain their original charm. The covenant, conditions and restrictions limit the use of the land to only one single family home and is of public record. The majority of the homeowners who are the successors of interest are bound by these restrictions which go with the land and are totally against this subdivision. This goes against the uniformity and character of this tract which is unique and rare to come by. The restrictions ensured spacious living, the ability to keep animals as pets, neighbors living far apart from each other, no obstruction to views and above all future protection against land abuse with addtional smaller and crowded homes on either side of the property lots. This subdivision if allowed will go against the very essence of what a CC&R stands for and will test the validity of such a document commonly used as part of Real Estate Law. |

2006 Summit Teaming up |
The 2006 Summit, Teaming Up Against Identity
Theft: A Summit on Solution held on 23 February 2006 was an overwheming success. Governor Arnold Schwarzenegger officially welcomed all participants. As a result of the interest in the Summit, a series of regional workshops on identity theft will be held later in the year. The California Department of Consumer Affairs encourage teamwork and education to fight identity theft and protect privacy rights.

West Islands Neighbors beat Annexation attempt. |
Residents aborted the Anaheim city's plan to annex a 495-acre county island with about 9,000 people which would have made Anaheim the most populous city in Orange County.
The county Registrar of Voters Office in record time verified 1,944 protest signatures. 50 percent plus 1 of the area's registered voters are needed to object to put the plan at rest.
The residents have spoken in a resounding way, so much so that historically it is the only annexation plan in the past five years that was stopped by signatures alone. |
